From September 1, 2023, heads of branches and representative offices of foreign companies can receive a qualified electronic signature from the Federal Tax Service certification center

The head of a branch or representative office of a foreign legal entity can obtain a qualified electronic signature certificate (QES) from the Certification Center of the Federal Tax Service of Russia. This can be done by personally visiting the tax authority that provides the service for issuing QES, and submitting a package of necessary documents
Federal Law No. 457-FZ, dated 04.08.2023 introduced changes to the procedure for issuing electronic signatures and working with electronic signatures. In particular, from September 1, 2023, heads of branches of foreign companies in the Russian Federation can, on general terms, receive qualified electronic signatures from the Federal Tax Service Center and use them for their intended purpose, including signing machine-readable powers of attorney for representatives.

To obtain a QES, the head of a branch or representative office of a foreign legal entity can personally contact the Federal Tax Service Certification Center that provides the service for issuing QES. In addition to the standard list of documents (passport, Tax ID, SNILS), the head of a branch or representative office of a foreign legal entity must submit:
  • TIN of a legal entity - a foreign organization,
  • KPP and number of the accreditation record of a branch (representative office) of a foreign organization (NZA),
  • a notarized power of attorney to vest the head of a branch or representative office of a foreign legal entity with the necessary powers on the territory of Russia.
