For 2024, a Decree of the Government of the Russian Federation approved the quota of foreign employees of September 16, 2023 N 1511
Suppose the employer's number of foreign employees in the relevant field of activity exceeds the established share. In that case, the employer must bring their number into compliance with acceptable standards by January 1, 2024.
The Government of the Russian Federation has the right to establish annually the permissible share of foreign employees employed by employers in various sectors of the economy (Clause 5, Article 18.1 of the Federal Law of July 25, 2002, N 115-FZ).
The quota of foreign employees established by type of activity for 2024 does not differ from those set for 2023. However, new particular limits have been established for some areas of Russia and specific industries.
If the requirement for the share of foreign employees is not met, the employer may be brought to administrative liability under Part 1 of Art. 18.17 Code of Administrative Offenses of the Russian Federation (for legal entities, the fine is up to 1 million rubles).
The limits do not affect foreign citizens with a temporary residence permit or residence permit. In addition, employers have the right to hire citizens of the EAEU (Belarus, Kazakhstan, Kyrgyzstan, Armenia) without considering restrictions on the protection of the national labor market.
